Kanun koyucu taraf\u0131ndan yap\u0131lan bu de\u011fi\u015fiklik\u00e7er\u00e7evesinde konusu kalmayan kurallara ili\u015fkin iptal talepleri hakk\u0131nda kararverilmesine yer olmad\u0131\u011f\u0131na karar verilmesi kanaatinde oldu\u011fumdan \u00e7o\u011funlukg\u00f6r\u00fc\u015f\u00fcne kat\u0131lmamaktay\u0131m. Belirtilengerek\u00e7elerle dava konusu kurallar\u0131n Anayasa\u2019n\u0131n 2., 9., 36. Maddelerineayk\u0131r\u0131 oldu\u011fu sonucuna ula\u015ft\u0131\u011f\u0131mdan \u00e7o\u011funluk karar\u0131na kat\u0131lm\u0131yorum. A\u00e7\u0131klanan nedenle konusu kalmayan maddeye ili\u015fkiniptal talebi hakk\u0131nda karar verilmesine yer olmad\u0131\u011f\u0131na karar vermek gerekir.<\/p>\n<p>Madde 19 &#8211; Genel Kurul kararlar\u0131, Cemiyet Lokalinde as\u0131larak \u00fcyelere duyurulur. G) Genel Kurul kararlar\u0131 toplant\u0131ya kat\u0131lan \u00fcyelerin salt \u00e7o\u011funlu\u011fuyla al\u0131n\u0131r. \u015eu kadar ki t\u00fcz\u00fck de\u011fi\u015fikli\u011fi ve derne\u011fin feshi kararlar\u0131, ancak toplant\u0131ya kat\u0131lan \u00fcyelerin \u00fc\u00e7te iki \u00e7o\u011funlu\u011fuyla al\u0131nabilir. Madde 15 &#8211; Genel Kurul, derne\u011fin en yetkili karar organ\u0131 olup; derne\u011fe kay\u0131tl\u0131 as\u0131l \u00fcyelerden olu\u015fur. As\u0131l \u00fcyeler, Cemiyetin organlar\u0131nda do\u011frudan do\u011fruya ya da dolayl\u0131 olarak yaln\u0131zca kendilerini, e\u015flerini ve 3. Dereceye kadar kan h\u0131s\u0131mlar\u0131n\u0131 ilgilendiren konularda \u00f6neride bulunamaz ve oy kullanamazlar. Madde 12 &#8211; Cemiyet \u00fcyeli\u011finden \u00e7\u0131kar\u0131lanlarla kendisi ayr\u0131lanlar b\u00fct\u00fcn haklar\u0131n\u0131 yitirmi\u015f olurlar. \u00dcyelikten \u00e7\u0131kar\u0131lanlarla istifa edenler ayr\u0131lma tarihlerine kadar var olan ve ger\u00e7ekle\u015fen her t\u00fcrl\u00fc bor\u00e7lar\u0131n\u0131 \u00f6demek zorundad\u0131rlar. \u00dcyelikten kendisi ayr\u0131lanlar\u0131n ya da \u00e7\u0131kar\u0131lanlar\u0131n kazan\u0131lm\u0131\u015f hak ve alacaklar\u0131 Cemiyete kal\u0131r.<\/p>\n<p>Verilen ilave s\u00fcre i\u00e7inde tezlerini sunmayanlar, ikinci defa haz\u0131rlad\u0131klar\u0131 tezleri kabul edilmeyenler, yabanc\u0131 dil yeterlik \u015fart\u0131n\u0131 yerine getirmeyenler ile ikinci s\u0131navda da ba\u015far\u0131 g\u00f6steremeyen veya s\u0131nav hakk\u0131n\u0131 kullanmayanlar, uzman yard\u0131mc\u0131s\u0131 unvan\u0131n\u0131 kaybederler ve \u00dcst Kurulda durumlar\u0131na uygun kadrolara atan\u0131rlar. Uzman yard\u0131mc\u0131l\u0131\u011f\u0131ndan \u00dcst Kurul uzmanl\u0131\u011f\u0131na atananlara bir defaya mahsus olmak \u00fczere bir derece y\u00fckseltilmesi uygulan\u0131r. (2) \u00dcst Kurul, medya hizmet sa\u011flay\u0131c\u0131lar\u0131n\u0131n se\u00e7im d\u00f6nemlerindeki yay\u0131nlar\u0131n\u0131 Y\u00fcksek Se\u00e7im Kurulunun kararlar\u0131 do\u011frultusunda izler, denetler ve de\u011ferlendirir. (3) Televizyon yay\u0131nc\u0131lar\u0131, ayr\u0131ca Avrupa S\u0131n\u0131r \u00d6tesi Televizyon S\u00f6zle\u015fmesine taraf ba\u015fka bir \u00fclkenin listesinde yer alan \u00f6nemli olaylarla ilgili m\u00fcnhas\u0131r haklar\u0131n\u0131, s\u00f6z konusu \u00fclke vatanda\u015flar\u0131n\u0131n \u00f6nemli bir kesimi taraf\u0131ndan izlenmesini engelleyecek \u015fekilde kullanamaz. (3) K\u0131sa g\u00f6sterimler, kayna\u011f\u0131n\u0131 belirtmek suretiyle sadece haber programlar\u0131 i\u00e7inde doksan saniyeyi ge\u00e7meyecek \u015fekilde kullan\u0131l\u0131r ve iste\u011fe ba\u011fl\u0131 medya hizmetlerinde ise sadece ayn\u0131 program\u0131n ayn\u0131 medya hizmet sa\u011flay\u0131c\u0131 taraf\u0131ndan banttan verilmesi durumunda uygulan\u0131r. (5) Program desteklemesinin, medya hizmet sa\u011flay\u0131c\u0131n\u0131n editoryal ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ve sorumlulu\u011funu etkilemesine izin verilmez. Program\u0131n ba\u015f\u0131nda, program i\u00e7indeki reklam ku\u015faklar\u0131na giri\u015f ve \u00e7\u0131k\u0131\u015fta ve program\u0131n sonunda program desteklemesi yap\u0131ld\u0131\u011f\u0131 belirtilirken, program\u0131 destekleyenin \u00fcr\u00fcn veya hizmetlerinin kiralanmas\u0131 veya sat\u0131n al\u0131nmas\u0131 do\u011frudan te\u015fvik edilemez ve \u00fcr\u00fcn veya hizmetlere a\u015f\u0131r\u0131 vurgu yap\u0131lamaz. 2) Yay\u0131n hizmeti faaliyetini y\u00fcr\u00fcten i\u015fg\u00fcc\u00fcn\u00fcn \u00f6nemli bir k\u0131sm\u0131n\u0131n, her iki \u00fclkede de yo\u011fun olarak faaliyet g\u00f6stermedi\u011fi durumlarda medya hizmet sa\u011flay\u0131c\u0131, faaliyetine T\u00fcrkiye\u2019de daha \u00f6nce ba\u015flam\u0131\u015f olmas\u0131 ve T\u00fcrkiye ekonomisi ile istikrarl\u0131 ve etkili bir ba\u011flant\u0131s\u0131n\u0131n bulunmas\u0131 h\u00e2linde T\u00fcrkiye\u2019de yerle\u015fik kabul edilir. Web sitemizdeki t\u00fcm makale ve i\u00e7eriklerin telif hakk\u0131 Av. T\u00fcm makaleler hak sahipli\u011finin tescili amac\u0131yla elektronik imzal\u0131 zaman damgal\u0131d\u0131r.<\/p>\n<ul>\n<li>Buradaki ama\u00e7 G\u00fcmr\u00fck ve Ticaret Bakanl\u0131\u011f\u0131\u2019n\u0131n operat\u00f6r\u00fc ve izinsiz SMS g\u00f6ndereni tespit etmesini kolayla\u015ft\u0131rmak.<\/li>\n<li>Bu d\u00fczenlemenin istisnas\u0131 ise bir hay\u0131r ve yard\u0131m maksad\u0131 ile , g\u00f6steri ama\u00e7l\u0131 veyahut \u00e7ok azda olsa bireysel ama\u00e7l\u0131 bahislere izin vermektedir.<\/li>\n<\/ul>\n<p>T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcyeliklerinde bo\u015falma olmas\u0131 halinde, ara se\u00e7ime gidilir. Ara se\u00e7im, her se\u00e7im d\u00f6neminde bir defa yap\u0131l\u0131r ve genel se\u00e7imden otuz ay ge\u00e7medik\u00e7e ara se\u00e7ime gidilemez. Ancak, bo\u015falan \u00fcyeliklerin say\u0131s\u0131, \u00fcye tamsay\u0131s\u0131n\u0131n y\u00fczde be\u015fini buldu\u011fu hallerde, ara se\u00e7imlerinin \u00fc\u00e7 ay i\u00e7inde yap\u0131lmas\u0131na karar verilir. Sendika ve \u00fcst kurulu\u015flar\u0131n\u0131n t\u00fcz\u00fckleri, y\u00f6netim ve i\u015fleyi\u015fleri, Cumhuriyetin temel niteliklerine ve demokrasi esaslar\u0131na ayk\u0131r\u0131 olamaz. T\u00fcrkiye&#8217;de yay\u0131mlanan s\u00fcreli yay\u0131nlar, Devletin \u00fclkesi ve milletiyle b\u00f6l\u00fcnmez b\u00fct\u00fcnl\u00fc\u011f\u00fcne, Cumhuriyetin temel ilkelerine, milli g\u00fcvenli\u011fe ve genel ahlaka ayk\u0131r\u0131 yay\u0131mlardan mahkum olma halinde, mahkeme karar\u0131yla ge\u00e7ici olarak kapat\u0131labilir.<\/p>\n<p>Devlet, \u00f6zel te\u015febb\u00fcslerin milli ekonominin gereklerine ve sosyal ama\u00e7lara uygun y\u00fcr\u00fcmesini, g\u00fcvenlik ve kararl\u0131l\u0131k i\u00e7inde \u00e7al\u0131\u015fmas\u0131n\u0131 sa\u011flayacak tedbirleri al\u0131r. Devlet ve kamu t\u00fczel ki\u015fileri; kamu yarar\u0131n\u0131n gerektirdi\u011fi hallerde, ger\u00e7ek kar\u015f\u0131l\u0131klar\u0131n\u0131 pe\u015fin \u00f6demek \u015fart\u0131yla, \u00f6zel m\u00fclkiyette bulunan ta\u015f\u0131nmaz mallar\u0131n tamam\u0131n\u0131 veya bir k\u0131sm\u0131n\u0131, kanunla g\u00f6sterilen esas ve usullere g\u00f6re, kamula\u015ft\u0131rmaya ve bunlar \u00fczerinde idar\u00ee irtifaklar kurmaya yetkilidir. Bu ama\u00e7la da\u011f\u0131t\u0131lan topraklar b\u00f6l\u00fcnemez, miras h\u00fck\u00fcmleri d\u0131\u015f\u0131nda ba\u015fkalar\u0131na devredilemez ve ancak da\u011f\u0131t\u0131lan \u00e7ift\u00e7ilerle miras\u00e7\u0131lar\u0131 taraf\u0131ndan i\u015fletilebilir. Bu \u015fartlar\u0131n kayb\u0131 halinde, da\u011f\u0131t\u0131lan topra\u011f\u0131n Devlet\u00e7e geri al\u0131nmas\u0131na ili\u015fkin esaslar kanunla d\u00fczenlenir. Madde 38&nbsp;\u2013&nbsp;Kimse, i\u015flendi\u011fi zaman y\u00fcr\u00fcrl\u00fckte bulunan kanunun su\u00e7 saymad\u0131\u011f\u0131 bir fiilden dolay\u0131 cezaland\u0131r\u0131lamaz; kimseye su\u00e7u i\u015fledi\u011fi zaman kanunda o su\u00e7 i\u00e7in konulmu\u015f olan cezadan daha a\u011f\u0131r bir ceza verilemez.<\/p>\n<p>(7) \u0130lgili ki\u015fi birinci f\u0131krada belirtilen cevap ve d\u00fczeltme hakk\u0131n\u0131, ayn\u0131 s\u00fcreler i\u00e7inde do\u011frudan sulh ceza mahkemesinden isteyebilir. (3) Genel ve tematik i\u00e7erikli yay\u0131n yapan televizyon kurulu\u015flar\u0131n\u0131n, \u00e7ocuk yay\u0131nlar\u0131nda \u00e7izgi filmlere yer vermeleri h\u00e2linde, \u00e7izgi filmlerin en az y\u00fczde yirmisinin, di\u011fer \u00e7ocuk programlar\u0131n\u0131n en az y\u00fczde k\u0131rk\u0131n\u0131n T\u00fcrk\u00e7e dilinde \u00fcretilmi\u015f yap\u0131m olmas\u0131 ve T\u00fcrk k\u00fclt\u00fcr\u00fcn\u00fc yans\u0131tmas\u0131 zorunludur. \u00c7ocuk yay\u0131nlar\u0131n\u0131n yay\u0131nlanma saatleri ve s\u00fcrelerine y\u00f6nelik istatistiksel veriler ile \u00fcretim yerine ili\u015fkin bilgiler ayl\u0131k d\u00f6k\u00fcmler h\u00e2linde \u00dcst Kurula bildirilir. (1) Yay\u0131n hizmetlerinde, genel veya tematik i\u00e7erikli yay\u0131n yap\u0131labilir. Medya hizmet sa\u011flay\u0131c\u0131 kurulu\u015flar yay\u0131n lisans\u0131 ba\u015fvurusu s\u0131ras\u0131nda yay\u0131nlar\u0131n\u0131n t\u00fcr\u00fcn\u00fc \u00dcst Kurula yaz\u0131l\u0131 olarak bildirir. \u00dcst Kurul taraf\u0131ndan bu kurulu\u015flara verilecek yay\u0131n lisans belgesinde yay\u0131n\u0131n t\u00fcr\u00fc a\u00e7\u0131k\u00e7a belirtilir. (5) Ticar\u00ee ileti\u015fim, medya hizmet sa\u011flay\u0131c\u0131n\u0131n editoryal ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ve program i\u00e7eri\u011fini etkileyecek \u015fekilde kullan\u0131lamaz. 1) Yay\u0131n hizmeti faaliyetini y\u00fcr\u00fcten i\u015fg\u00fcc\u00fc her iki \u00fclkede de bulunmakla birlikte, hangi \u00fclkede daha yo\u011fun olarak \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131n\u0131n tespit edilemedi\u011fi durumlarda medya hizmet sa\u011flay\u0131c\u0131, \u015firket merkezinin bulundu\u011fu \u00fclkede yerle\u015fik kabul edilir.<\/p>\n<p>Bu unsurlar, kusur, hukuka ayk\u0131r\u0131l\u0131k, zarar ve zararile zarara sebep olan olay aras\u0131nda uygun nedensellik ba\u011f\u0131n\u0131n bulunmas\u0131\u015feklinde s\u0131ralanabilir. \u00d6te yandan kanunlar\u0131m\u0131zda kusursuz sorumluluk halleride d\u00fczenlenebilmektedir. \u0130stisnai olan bu d\u00fczenlemelerde sorumlulu\u011fun kurulmas\u0131kusur yerine \u00f6zel olarak \u00f6ng\u00f6r\u00fclen bir olguya (sebep olma esas\u0131) ba\u011flanm\u0131\u015ft\u0131r.Ancak belirtmek gerekir ki, sebep olma esas\u0131, bir kusursuz sorumluluk rejiminin\u00f6ng\u00f6r\u00fclmesi i\u00e7in tek ba\u015f\u0131na yeterli de\u011fildir. Bu nedenle, kusursuz sorumlulukrejiminin kabul edilebilmesi i\u00e7in sebep olma esas\u0131n\u0131n yan\u0131 s\u0131ra kusurilkesinden ayr\u0131lmaya neden ihtiya\u00e7 oldu\u011funu gerek\u00e7elendiren ba\u015fka esaslar daaran\u0131r. Kusursuz sorumluluk istisna olup \u00f6ng\u00f6r\u00fclmesi i\u00e7in birden fazla esas(veya gerek\u00e7e) gerekmektedir. Bu halde yer sa\u011flay\u0131c\u0131n\u0131n i\u00e7erikten sorumluolmamas\u0131, sorumlulu\u011funun ikincil olmas\u0131 ve tamamen soyut bir zarar tazminisorumlulu\u011fu alt\u0131nda b\u0131rak\u0131lmas\u0131n\u0131 konu edinen s\u00f6z konusu d\u00fczenleme Anayasa\u2019n\u0131n2. Temel haklara y\u00f6nelik m\u00fcdahalelerin anayasaya uygunlu\u011fundan s\u00f6zedebilmek i\u00e7in \u00f6ncelikle ilgili maddelerde belirtilen me\u015fru bir ama\u00e7 ta\u015f\u0131mas\u0131gerekmektedir. Yukar\u0131da a\u00e7\u0131kland\u0131\u011f\u0131 gibi yasan\u0131n gerek\u00e7esinde ifade edilentemsilci atama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn amac\u0131n\u0131n mahkeme kararlar\u0131n\u0131 uygulamak oldu\u011fuamac\u0131n\u0131n ikna edici olmad\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. Di\u011fer taraftan sosyal medyaplatformlar\u0131n\u0131n kazan\u00e7lar\u0131ndan vergi alma amac\u0131 oldu\u011fu da gerek\u00e7ede yeralmaktad\u0131r. Ancak yukar\u0131da belirtilen haklar\u0131n s\u0131n\u0131rland\u0131rma nedenleri aras\u0131ndavergi elde etme amac\u0131 yer almad\u0131\u011f\u0131 gibi ba\u015fka bir \u00fclkede o \u00fclke yasalar\u0131na g\u00f6rekurulan ve faaliyetlerini ba\u015fka bir \u00fclkede y\u00fcr\u00fcten bir i\u015fletmeninkazan\u00e7lar\u0131ndan vergi elde etme iste\u011finin ne \u00f6l\u00e7\u00fcde me\u015fru bir ama\u00e7 oldu\u011fu datart\u0131\u015fmal\u0131d\u0131r. Nihayetinde T\u00fcrk vatanda\u015flar\u0131 taraf\u0131ndan hizmetlerindenyararlan\u0131lm\u0131\u015f olmas\u0131 bu \u015firketlerin T\u00fcrkiye\u2019de faaliyet g\u00f6sterdi\u011fi anlam\u0131nagelmemektedir.<\/p>\n<p>T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinin b\u00fct\u00fcn bina, tesis, eklenti ve arazisinde kolluk ve y\u00f6netim hizmetleri Meclis Ba\u015fkanl\u0131\u011f\u0131 eliyle d\u00fczenlenir ve y\u00fcr\u00fct\u00fcl\u00fcr. Emniyet ve di\u011fer kolluk hizmetleri i\u00e7in yeteri kadar kuvvet ilgili makamlarca Meclis Ba\u015fkanl\u0131\u011f\u0131na tahsis edilir. Meclis Ba\u015fkan\u0131 da do\u011frudan do\u011fruya veya \u00fcyelerin be\u015fte birinin yaz\u0131l\u0131 istemi \u00fczerine, Meclisi toplant\u0131ya \u00e7a\u011f\u0131r\u0131r.
